The following privacy policy (the “Privacy Policy”) discloses the guidelines CellMax, Inc. (“CellMax”) has established for use and protection of the information you provide and create when using CellMax’s website, currently accessible at www.cellmaxlife.com (the “Site”).

  1. What information about me does CellMax collect?

CellMax collects information about you, including personally identifiable information, when you send information to us via email, web forms, or otherwise. This information may include your name, internet protocol (“IP”), physical and email addresses. CellMax does not share, rent or sell information concerning CellMax’s website users to third parties in ways other than disclosed in this Privacy Policy.

When you visit the Site, a cookie may be stored on your computer. Generally, cookies work by assigning to your computer a unique number that has no meaning outside of CellMax. CellMax’s cookies do not contain any personally identifying information; CellMax uses the cookies to provide features such as personalization. CellMax may also use cookies to assist it in delivering content specific to your interests. Most Web browsers automatically accept cookies, but you can usually alter your browser to prevent that. Not accepting cookies may make certain features of the Site unavailable to you. CellMax may also use your IP address to identify you, to administer the Site and to assist in diagnosing problems with CellMax’s server.

Like most standard website servers, the Site uses log files. Stored information includes IP addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks. This information is used to analyze trends, administer the Site, track a user’s movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to personally identifiable information. In addition, CellMax uses Google Analytics as a method of tracking site statistics and user behavior on the Site. CellMax may also collect certain health and medical information about you that is protected under the Health Insurance Portability and Accountability Act (“HIPAA”) and applicable state law.  This information may be provided by you online or offline, or may be collected by CellMax from other methods such as through a health care provider.  We protect covered health and medical information as required by HIPAA and applicable state law.  Similarly, we may use covered health and medical information as permitted by HIPAA and applicable state law.  In the event of any conflict between our HIPAA Notice of Privacy Practices and this Privacy Policy, the terms of our HIPAA Notice of Privacy Practices shall control.

  1. How does CellMax use the information it collects from me?

Your information, including personally identifiable information, may be stored by CellMax and used for various purposes, including internal research in order to improve the Site and user experience and other CellMax marketing purposes, including e-mailing you with special promotions and other programs of interest. CellMax may also use your information to personalize, customize, measure, and improve our services, content, and advertising and otherwise to enhance your experience of the Site; to prevent, detect and investigate potentially prohibited or illegal activities, and to enforce the Site’s terms and conditions (as amended and updated from time to time, the “Terms of Use”); to analyze the effectiveness, usability, or popularity of the Site; to generate and review reports and data about our user base and Site usage patterns; to compile aggregate data for internal and external business purposes; to resolve disputes and troubleshoot problems; to provide you with other services requested by you as described when we collect the information; and to take any other action as otherwise stated in this Privacy Policy or our Site Terms of Use.

If the information is sent by you as part of your evaluation of the Site, CellMax may also use the information to contact you about your comments. CellMax may use your email address to send you newsletters with updates and news about CellMax, and may use your phone number to contact you regarding CellMax services. You may remove your contact details from our email and phone lists by contacting us at info@cellmaxlife.com. You may decide to send CellMax personally identifiable information in an e-mail message which might contain information or inquiries about CellMax’s products or services. CellMax may use this information to respond to the e-mail.

  1. When does CellMax disclose information to third parties?

CellMax may disclose your information to the following third parties:

Our Service Providers: We may share your information with third-party contractors or service providers who provide certain services to us or on our behalf, such as operating and supporting the Site or responding to your requests. These service providers will only have access to the information needed to perform these limited functions on our behalf and are required to provide your information with at least the same level of protection and security as we use for the Site.

Companies that Acquire Our Business or Assets. If CellMax becomes involved in a merger, acquisition, sale of assets, securities offering, bankruptcy, reorganization, dissolution, or other transaction or if the ownership of all or substantially all of our business otherwise changes, CellMax may share or transfer your information to a third party or parties in connection with the applicable transaction.

Our Affiliates. We may share some or all of your information with our subsidiaries and corporate affiliates, joint venturers, or other companies under common control with us. We will require these entities to comply with the terms of this Privacy Policy with regard to their use of your information.

Aggregate Information. CellMax may share information relating to visitors and users of the Site with affiliated or unaffiliated third parties on an aggregate basis. We note that, while this information will not identify you personally, in some instances these third parties may be able to combine this information with other data they have about you, or that they receive from third parties, in a manner that allows them to identify you personally.

Legal Requirements. To the extent permitted by law, we may share your information with law enforcement, governmental agencies, or authorized third parties, in response to a verified request relating to an official investigation or alleged illegal activity or any other activity that may expose us, you, or any other CellMax user to legal liability, or to protect our rights or property, or during emergencies when safety is at risk. DMCA Notices. We may share your information with third parties when we forward Digital Millennium Copyright Act (“DMCA”) infringement notifications and counter-notifications as described in the Site’s Terms of Use. DMCA infringement notifications and counter-notifications (including any personal information included as part of the notifications) will be forwarded as submitted to us without any deletions.

Unforeseeable or Unpreventable Disclosures. Your information may be disclosed to third parties in unforeseeable situations or situations that are not preventable even when commercially reasonably protections are employed, such as in the case that CellMax or the Site is subject to a hacking or other attack.

CellMax encourages you to use this to check the validity of any site you connect to using secure communications.

You should carefully review security/privacy policies of any third party sites accessible from the Site. Other sites accessible through the Site have their own policies and data collection, use, and disclosure practices. Please consult each site’s policies and practice. CellMax is not responsible for the policies or practices of third parties. The information practices of those websites linked from the Site are not covered by this Privacy Policy. These other sites may send their own cookies to users, collect data, or solicit personal information.

  1. What if information I have previously submitted has changed?

If you need to correct, amend or delete submitted information that is inaccurate, please contact CellMax at info@cellmaxlife.com. CellMax will generally respond to your email request within 7-10 business days.

  1. Does CellMax offer opt-out or opt-in services?

Yes. If you choose to stop receiving emails from CellMax, please follow the unsubscribe instructions within each email communication or contact us at info@cellmaxlife.com. Any service related emails (to confirm a purchase, etc.) generally do not offer an option to unsubscribe as they are necessary to provide the service you requested.

  1. How is my information retained?

We retain information for active CellMax accounts as long as it is necessary and relevant for our operations. In addition, we may retain information from closed accounts to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, enforce the Site’s Terms of Use and take other actions permitted by law. The information we retain about you will be handled in accordance with this Privacy Policy.

  1. Privacy Policy Changes.

If CellMax makes changes to any terms or conditions of this Privacy Policy, the updated Privacy Policy will be posted on the Site in a timely manner. CellMax reserves the right to modify this Privacy Policy at any time, so please review it frequently.

  1. United States and Taiwanese Operation.

The CellMax website is operated from the United States and Taiwan. If you are located outside of the United States and choose to use the Site or provide your information to us, your information will be transferred, processed and stored in the United States in accordance with U.S. legal requirements. U.S. privacy laws may not be as protective as those in your jurisdiction. You acknowledge and consent to this practice. If you do not want your information transferred to or processed or stored in the United States, you should not use the Site. Use of the Site by users outside of the United States is at your own risk.

  1. California Do Not Track Disclosure.

You may be able to adjust your browser settings or other settings so that “do not track” requests are sent to the Site. CellMax will not disable tracking technology that may be active on the Site in response to any “do not track” requests that are sent to the Site.

CellMax does not permit third parties to collect personally identifiable information about your online activities over time and across different websites when you use the Site.

This Privacy Policy will be interpreted under the laws of California and of the United States. To the extent you are accessing the Site from outside of the United States, you do so at your own risk. If you are located outside the United States, you should be aware that information you provide may be transferred to the United States. The data protection laws of the United States may not be as comprehensive as those in your country. While CellMax continues to work hard to protect your personal information, no data transmission over the Internet can be guaranteed to be absolutely secure, and CellMax cannot ensure or warrant the security of any information you transmit to CellMax. Transmitting personal information is done at your own risk.
